Judicial ReviewThe High Court has the power to review the decisions of bodies exercising statutory function including Courts and Tribunals. It can rule such decisions to be unlawful for the following reasons: · Excess or want of jurisdiction. · Failure to comply with rules of natural justice. · Procedural unfairness. This is an important function as the decisions of tribunals often cannot be appealed. Judicial review provides a means of monitoring the exercise of the functions of such tribunals. |
