Breach of Duty

Breach of duty of care is a question of fact.

The breach can be:

·         negligent;

·         fraudulent.

A breach is negligent if the performance of the duty is not up to the standards of objective reasonableness.

A fraudulent breach will occur where the breach results from some kind of dishonesty.
