Exclusion of LiabilityA party committing a tort may seek to rely on a purported exclusion of liability clause. This may take the form of a notice board in respect of land (the Occupiers' Liability Act imposes certain duties of care) or a disclaimer on a statement. To determine whether such a clause will be effective, it should be read in the light of UCTA. UCTA applies even though there may not be a contract and as such the name of the Act is misleading. |
